Terms and Conditions for the Poker.no App (NM PokerApp)

By downloading, installing or using the Poker.no app (“NM PokerApp”, the “App”), you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, you must not use the App.

The App is provided by PKR AS (“we”, “us”, “our”).

PKR AS was established in 2014 and is engaged in the sale of poker equipment and the organisation of poker events.

The App is a service connected to Poker.no and may provide access to, for example:

• News and information about poker and poker events
• Information about tournaments, schedules, structures and results
• Your personal tournament schedule
• Festival and tournament details (including data from third‑party providers such as PokerLens and kHoldem)
• Player profiles, statistics and historical results
• Fantasy‑style features (e.g. selecting players and earning points)
• Registration or linking to registration for events (where available)
• Push notifications with relevant information

The functionality of the App may be changed or updated at any time.

• The App does not offer real‑money gambling.
• Fantasy features and points systems in the App are provided for entertainment purposes only and do not pay out money or other prizes of monetary value.
• Participation in live events is governed by separate tournament rules and the local laws of the jurisdiction where the event is held.
• Any success in fantasy or simulated play in the App does not indicate or guarantee success in real‑money gambling.

By using the App, you:

• Confirm that you have read and understood these Terms
• Agree that these Terms apply to all use of the App
• Accept that the Terms may be updated from time to time, and that continued use of the App after such changes means that you accept the updated Terms

If you do not accept these Terms, you must not use the App.

The App is primarily aimed at adult users.

To:

• Create an account in the App, and
• Register for tournaments or events through the App where an age limit applies

you must be at least 18 years old, or meet any higher age requirement that applies to the relevant event. We reserve the right to request proof of age in connection with events.

The App contains information related to poker, which in Norway is an 18+ activity. By using the App, you confirm that you meet this requirement.

The App may allow you to log in using a user profile, for example via:

• Email and password
• Third‑party login providers (e.g. Apple or Google)

As a user, you are responsible for:

• Ensuring that the information you provide is correct and up to date
• Keeping your login information confidential and not sharing it with others
• All activity carried out through your account

If you suspect that your account is being misused, you must contact us immediately at app[a]poker.no.

We may suspend or close an account in case of:

• Breach of these Terms
• Misuse, fraud attempts or other unacceptable behaviour
• Technical, security‑related or operational reasons

At launch, the App’s core features are provided free of charge. There are no paid subscriptions or in‑app purchases at this time.

If the App later offers the possibility to purchase goods or services (e.g. via links to poker.no or integrated shop functionality):

• The same terms of sale and delivery as on poker.no will apply to such purchases
• All prices will be shown in NOK and include VAT, unless otherwise stated
• The total cost, including any shipping, fees and charges, will be shown before you confirm a purchase

In the event of any inconsistency between these App Terms and the poker.no webshop terms for a specific purchase, the webshop terms will prevail for the purchase itself.

PKR AS processes personal data in accordance with applicable data protection laws, including the GDPR.

We may process information such as:

• Name, contact details and login information
• Information related to events and tournaments you participate in
• Technical data about your use of the App (e.g. device information and usage patterns)

The purposes may include:

• Providing and improving the App and its services
• Administering registrations and participation in events
• Customer support and communication
• Security, fraud prevention and misuse detection

Personal data that can be linked to you will not be made available to other companies beyond what is necessary to deliver the service (e.g. technical hosting partners), unless we are legally required to disclose it.

Detailed information about how we collect, use and protect personal data is provided in our Privacy Policy, which is available in the App and on Poker.no (e.g. at https://www.poker.no/privacy-policy-app/). The Privacy Policy forms part of these Terms.

The App may send you push notifications regarding:

• News and updates
• Information about upcoming events and schedule changes
• Important information related to tournaments you are registered for
• Table changes / seat moves during tournaments you are participating in
• Start times and status updates for tournaments you are registered for

You can normally manage push notifications in your device’s settings and, where available, in the App’s own settings.

We may also contact you by email or in‑app messages for important information about your account, security notices or changes to these Terms.

All content in the App belongs to PKR AS or our partners, including but not limited to:

• Text, images, video, graphics and logos
• The structure, design and underlying code of the App
• Databases and tournament information

You are granted a limited, non‑exclusive, non‑transferable right to install and use the App on your own device in accordance with these Terms.

You may not:

• Copy, modify, distribute, publish or commercially exploit the content without our prior written consent
• Decompile, reverse engineer or otherwise attempt to derive source code, except where permitted by mandatory law

If the App allows you to submit or upload content (for example names, comments, profile images or similar):

• You are solely responsible for the content you submit
• You warrant that you have the necessary rights to such content
• You must not submit content that is unlawful, offensive, threatening, discriminatory, defamatory or otherwise inappropriate

PKR AS may remove content without notice if we consider it to be in breach of law or these Terms.

You agree not to use the App for:

• Attempts at unauthorised access to systems, data or accounts
• Manipulating tournament data or attempting to cheat in relation to events
• Distributing viruses, malicious code or otherwise harming the service or other users
• Marketing, spam or other commercial activities without our prior written consent

To ensure fair play in fantasy features and other game‑like elements of the App:

• Each natural person may only maintain one user account and one active fantasy team per relevant competition, unless we explicitly state otherwise.
• Creating multiple accounts or teams to gain an unfair advantage, circumvent limits or influence rankings is strictly prohibited.
• We may use phone number verification or similar mechanisms to ensure that one person only participates with one account and one team.
• PKR AS reserves the right to remove duplicate teams, disqualify participants, adjust points or close accounts that violate these rules.

PKR AS may change or update:

• The functionality and content of the App, and/or
• These Terms

Material changes to the Terms will normally be notified via the App or on Poker.no. Continued use of the App after changes have been published constitutes acceptance of the updated Terms.

We may also discontinue the App, in whole or in part, temporarily or permanently. In such cases you are not entitled to compensation, except as required by mandatory consumer law.

The App is provided “as is” and “as available”, without any warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose or non‑infringement.

We do not guarantee that:

• The content will always be complete, correct or up to date
• The App will be error‑free or available without interruptions
• All features will be available on all devices at all times

To the maximum extent permitted by Norwegian law, PKR AS is not liable for any direct or indirect losses, including but not limited to:

• Downtime, technical errors or lack of access to the App
• Errors or omissions in data, tournament information or other content
• Third‑party services or websites linked to from the App

Nothing in these Terms limits your rights as a consumer beyond what is permitted by mandatory law.

The App may use or link to third‑party services, such as:

• Apple Sign In and Google Sign‑In (for authentication)
• PokerLens, kHoldem and similar data providers
• External websites, including poker.no

Your use of such services is subject to the relevant third party’s own terms and privacy policies, which you must read and accept separately. PKR AS is not responsible for the content, security or practices of third‑party providers.

These Terms apply for as long as you use the App.

You may at any time:

• Stop using the App, and/or
• Uninstall the App from your device

PKR AS may terminate or suspend your access to the App or delete your account if:

• You materially or repeatedly breach these Terms
• You misuse the service, attempt fraud or engage in unlawful activity
• It is necessary for technical, security or operational reasons

For complaints related to:

• Purchases of goods or services through Poker.no, the webshop’s own terms of sale, complaint rules and right of withdrawal apply.

We follow applicable Norwegian rules on complaints and right of withdrawal where relevant.

These Terms are governed by and interpreted in accordance with Norwegian law.

Any disputes that cannot be resolved amicably shall be brought before the Norwegian courts, with Follo District Court as the agreed venue, unless otherwise required by mandatory consumer protection law.

If you access the App on an Apple device, the following additional terms apply:

• These Terms are between you and PKR AS only, not with Apple.
• Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple will have no other warranty obligations with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third‑party terms when using the App.
• Apple and Apple’s subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you as such.

By using the Poker.no App (NM PokerApp), you confirm that you have read, understood and accepted these Terms.
